Hosted by Fox Business Network, the debate saw the other candidates attack President Barack Obama’s State of the Union address earlier this week.
“He was born in Canada”.
Scavino, however, didn’t include a link to the entire court filing. “Honestly, we don’t know”. Should Cruz persist in seeking the presidency without establishing once and for all that his birth in Canada isn’t disqualifying, Trump warns, he’s setting himself up for an avalanche of lawsuits. He argues that he is a natural born citizen because he did not have to go through the naturalization process, and therefore is eligible to run for president. That could be seen as legally flimsy, according to a 2008 piece by Ohio State University Professor Dan Tokaji in the Michigan Law Review. Cass Sunstein, also of Harvard, writes in Bloomberg View that, as of 1787, the British statutes would have required Cruz’s father, not his mother, to be a citizen.
My younger siblings were born at U.S. Air Force bases overseas during the Cold War.
A similar lawsuit was filed in Broward County, Florida, in December, challenging Cruz and Rubio on the same grounds. “So let the people decide”, Branstad told reporters at a press conference. “But for purposes of 2016, it would be the Supreme Court, and what they have to say would override the FEC or anyone else”.
On the meaning of “natural-born”, which originates in British law, some scholars say it indicated a requirement to be born in the country.
Should be understood as a lay member of the public would understand it or whether is a legal term of art?…Fixed concept [or] common law concept subject to evolutionary development?…Depends only on English common law authorities [or] on statutory changes?…Has become liquidated in practice by congressional statutes?…can not be altered by Congress [or] read together with Congress’s powers under the Naturalization Clause?
Sanchez noted that Cruz’s parents had voted in Canadian elections, which requires citizenship in Canada. He obviously knows a lot about the law, but he also knows a lot about Cruz – because back in the mid-1980s, Tribe taught constitutional law to Cruz. In theory, I guess, raising enough doubt about Cruz’s eligibility could cause some libertarians and “constitutionalists” to run away from Cruz and back to Paul, but how much is that worth to Paul? And beyond that, while Trump is doing well with voters in Iowa, Cruz is dominating with likely primary voters at the moment. Mr. Cruz would then have the same legal status as children born in US territory to undocumented immigrants.
“You had people like Rush Limbaugh, Ted Cruz, and other Republicans saying Obama was born in Kenya”, Schwartz said.
But Cruz’s mother was an American, and that automatically conferred American citizenship on him as well. Plaintiff Newton B. Schwartz Sr. told Bloomberg he doesn’t have a strong feeling about the question, but simply wants it to be settled before Cruz potentially could be elected.
“Courts are often reluctant to get involved in divisive political questions, Muller said. I’m just wanting the court to clarify”.
