Trump went onto describe the conservative judge as an individual who closely defines “what we are looking for”.
SMU constitutional law professor Dale Carpenter said while it is an important pick, it will not vastly change the look of the U.S. Supreme Court. He came to national prominence in the United States a few years ago when he ruled in favour of the famous Hobby Lobby case.
Gorsuch is best known nationally for his role in the Hobby Lobby case, in which the company opposed on religious grounds the ObamaCare mandate that it provide contraceptives to employees.
“I know that they say they’re going to filibuster I think anyone that our new president is going to nominate“.
Why did he get the nomination? .
“In Judge Neil Gorsuch, President Trump has fulfilled his pledge to nominate a judge who has a demonstrated loyalty to the Constitution and a strong commitment to life”, House Speaker Paul Ryan said in a statement”.
Trump praised Gorsuch for his “extraordinary resume” and said his academic credentials were “as good as I have ever seen”. Both Trump and Gorsuch heaped praise on Scalia during the announcement on Tuesday.
Gorsuch, a conservative, is Trump’s fulfillment of a promise to hastily fill the nearly year-long vacant seat that Scalia left.
What difference will he make? .
If confirmed, Gorsuch would restore the 5-4 conservative majority on the nine-member court that existed with Scalia on the bench. Now there are four conservative justices and four liberal Justices and one vacant seat.
Alito is one of the more conservative judges and was nicknamed “Scalito” for his similar conservative leanings to Scalia. He seems willing to demolish the filibuster for Supreme Court picks, a move that outsiders are already calling a “nuclear option“.
There is now an empty seat in the Supreme Court, due to the death of Justice Scalia. “Was it?” Trump asked the crowd in the hall, as Gorsuch and his wife came up to the podium.
At the same time though, Senate Dems like Merkley are ready to put up on of their first major affronts to the Trump administration.
The call by Schumer – the top Democrat in the Republican-controlled Senate that will vote on Gorsuch’s nomination – to insist on a 60-vote bar extends the rising backlash to what Trump critics consider his extreme policies, namely last week’s executive order on refugee and immigration policies.
The Center for Public Integrity reviewed the judge’s recent annual financial disclosures, including the most recent covering 2015. Many of them refer to this seat as the “stolen seat” as it was left vacant as Republicans refused to confirm a nominee from a “lame duck” president.
The real fight comes over the next vacancy, whether it’s created by the departure of moderate Justice Anthony Kennedy or liberals Ruth Bader Ginsburg and Stephen Breyer.
