Cosby Trial, Day 3: Chief accuser denies any prior romance

Andrea Constand, whom Cosby is accused of assaulting, took the stand Tuesday as the prosecution’s star witness. the former Temple University employee told jurors about a night in 2004 when she said Cosby drugged her at his home outside Philadelphia.

When the prosecutor asked the accuser why didn’t she try to stop Cosby, she said, “I wasn’t able to”.

He asked what he could do to help, and she said all she wanted was an apology. But when she reported the alleged attack to Canadian police on January 13, 2005, she said it happened in March 2004, after she’d gone out to dinner with Cosby and others at Central High School in Philadelphia, Cosby’s defense lawyers said.

But Constand says she never got the records from Temple University for the work-issued phone.

Cosby, his good-guy reputation already in ruins, could get 10 years in prison if convicted of aggravated indecent assault.

Constand said she continued to be friendly with Cosby, until the alleged sexual assault in 2004. The jury was selected in the Pittsburgh area because of the heavy publicity surrounding the case and is sequestered at a hotel for the duration of the trial, expected to last two weeks. He says she told him and two other investigators that she felt Cosby place “something foreign” in her genitals but wasn’t specific.

Cosby’s lawyer, Angela Agrusa, focused not on the details of the alleged assault but on other aspects of Constand’s narrative, including discrepancies in several police interviews Constand gave in 2005 when she made a decision to report the crime a year later. Constand said she told Cosby she was not interested. Constand said the mood was friendly and the room light enough to eat. She also said she received another call in which her daughter claimed Cosby was pressuring her boss, the comedian’s agent, to get rid of her.

Numbers Game: The defense confronted Constand with her phone records, enlarging them on a screen for the benefit of jurors. He said he could not read the prescription bottle, Gianna Constand testified, so he agreed to write it down and send it to her. “I felt really humiliated and I was really confused”.

“You told police that you were lying on the bed, your legs were touching”, Agrusa challenged Constand.

She also denied suggestions there was any kind of a romantic relationship between her and Cosby.

The defense says the relationship with Constand was consensual. Cosby is accused of drugging and sexually assaulting Constand a. She said he gave her three blue pills after having dinner with him and was told to take them because they would “take the edge off”.

Cosby has faced sexual assault allegations from dozens of women, though Constand’s accusation is the only one to lead to criminal charges.

“My dress was pulled up from the bottom, and it was pulled down from the top, and my breasts were out”, she said, crying.

“She’s (Andrea Constand) seldom emotional”.

Cosby said in a recent interview that he won’t testify. In the deposition, Cosby confessed to obtaining strong sedatives to hand out to females he wanted to have sex with, although he insisted he didn’t use them when he is alleged to have assaulted Constand. And she asked, are they herbal?

Agrusa has suggested that Constand once enjoyed a romantic dinner by the fire at Cosby’s home before the alleged assault.

Cosby, the actor and comedian who has been a household name for half a century, is charged with sexually assaulting Constand in his Cheltenham home in 2004.
