Cosby sues accuser Constand, lawyer, mother over contract

In 2004, Constand, a former employee of Temple University, accused Cosby of drugging and molesting her at his Pennsylvania home.

Prosecutors in Los Angeles County last month decided not to charge Cosby over two alleged cases of sexual assault dating to 1965 and 2008. It came hours before one of Constand’s lawyers, Troiani, took the stand at Cosby’s February 3 criminal hearing, The New York Daily News reported.

At that hearing, Constand’s lawyer, Troiani, testified and mentioned that Cosby had sued her but did not elaborate.

The suit also alleges that American Media Inc., which owns the National Enquirer, has continued to publish numerous stories about Constand’s claims regarding Cosby “despite its clear contractual obligations to not publish any stories relating to certain allegations against Mr. Cosby”. While he has been married for decades, Cosby has denied the accusations – many of which the statue of limitations expired in cases against him. The suit also faults Constand’s mother, lawyers, and the National Enquirer. Based on this belief, in 2005 he gave a damning deposition in a civil case that resulted in a payout by other alleged victims and Constand. Bill Cosby is suing the woman whose accusations led to the only criminal charges filed against the fallen TV icon.

Cosby, the lawsuit said, has suffered “serious and irreparable harm” and should be compensated by damages “to be proven at trial”.

A spokesman for Cosby’s lawyers said it was unclear if they would appeal to the state Superior Court.

The judge rejected his bid to have the criminal case dismissed.

It’s the second civil suit Cosby has filed against some of the five-dozen women who have accused him of drugging and/or raping them in episodes dating back to the mid-1960s.

Troiani declined to comment on Cosby’s lawsuit. Even more damning, Cosby answered “Yes” when asked: “When you got the Quaaludes, was it in your mind that you were going to use these Quaaludes for young women that you wanted to have sex with?”

The criminal case against Cosby moves forward with a preliminary evidence hearing March 8.

The seal on Cosby’s suit was partially lifted Tuesday.
