The jury on Friday heard the comedian’s version of the call, in which he admitted to apologising to Ms Constand’s mother – but only for fear of coming off as a “a dirty old man“.
“Have you ever used this vehicle of an educational trust … as a way of giving money to any other woman with whom you had a relationship?” he was asked in the deposition. All but Constand’s are too old to support criminal charges under the statute of limitations.
Andrea Constand, the accuser at the center of Bill Cosby’s sexual assault trial, told police during a 2005 interview that she is gay, though she had a boyfriend as a teen and sexual contact with a man in her 20s. This section focused on Cosby’s description of the phone calls between him and Andrea Constand’s mother, Gianna. She says Mr Cosby told her, “I apologise to Andrea. and I apologise to you, mom”. “I learned more about it from the defendant than I did from her”.
Cosby testified at the time that he was anxious about his public image.
Cosby testified that Constand was “talking about stress” and that he gave Constand Benadryl, “the equivalent of one and a half”.
According to Patten’s Thursday night dispatch, Wyatt suggested that Cosby was in a “good mood” about the developments of the trial. And I don’t feel her say anything.
“My wife would not know it was because Andrea and I had had sex and that Andrea was now very, very upset”, Cosby said, according to the transcript.
Cosby’s testimony also showed he anxious that his career could take a financial hit if Constand’s allegations became public.
As Cosby walked from the courtroom at the end of the day, a woman yelled: “Bill Cosby, I love you!” In a scathing address to the judge, he argued that Dr. Valliere’s words were tantamount to instructing the jury to reach a certain verdict in the Cosby case.
Defense attorney Brian McMonagle arrives at the Montgomery County Courthouse on June 9, 2017, for the fifth day of Bill Cosby’s sexual assault trial.
Montgomery County police officer James Reape read the deposition, in which Cosby described apologizing to Constand’s mother on the phone in 2006. One was white, one green and the third pink. An analysis of the pills conducted by National Medical Services in August 2015 determined the pink pills to be Benadryl. “It can and has been used as a drug to facilitate sexual assaults”, testified Rohrig, adding quaaludes, which are now illegal in the USA, are also sedatives and can cause similar side-effects.
The cross-examination ended quickly, with McMonagle pointing out that Cosby has consistently maintained since 2005 that Constand did consent.
Another detail revealed in the now-public deposition was that Cosby apologized to Constand’s mother, though not, he says, for any kind of assault.
Instead, he said his “family” would write a personal check to cover the costs of Constand’s education.
Ms Constand testified this week that Cosby gave her pills that made her woozy, then violated her.
This psychological analysis boosted the prosecution’s case by explaining Constand’s behavior and assuring the jury that alleged inconsistencies in her testimony aren’t reason to discredit the entire account.
