The 28-year-old, whose real name is Kesha Rose Sebert, claims that Dr. Luke drugged her with a “sober pill” and raped her shortly after her 18th birthday in California.
New York Supreme Court Justice Shirley Kornreich reportedly denied a preliminary injunction for Kesha that would’ve allowed her to record music outside of Dr. Luke’s purview. “My instinct is to do the commercially reasonable thing”, she continued.
Kesha’s lawsuit, filed in Los Angeles in 2014, accuses hit-making producer Dr. Luke of raping her and subjecting her to other sexual and emotional abuse for almost a decade.
The judge stated “there has been no showing of irreparable harm” against Kesha’s career at this point.
This past Friday (Feb. 19) both the singer and her alleged abuser Dr. Luke were present in a New York City courtroom, where the request was denied.
Outside the court room, fans showed their support for the singer during a previously organized #FreeKesha rally.
Kesha legally has to have six songs produced on her album by Dr Luke. A petition to “Free Kesha” from her Sony contract cropped up a few months ago, and more than 120,000 people have signed it. Today, her legal team fought and lost an injunction that would have prevented Kesha from working with Dr. Luke.
However, a judge dismissed her argument on Friday (19Feb16), ruling she is able to work with another producer under Sony. Dr. Luke filed a counter-claim in NY alleging defamation and breach of contract.
“She can not work with music producers, publishers, or record labels to release new music”. It’s the latest blow against Kesha’s fight for freedom from the producer’s label, which she’s been trying to leave for over a year.
