Ellen Sigal, a court-appointed attorney for Rocco Ritchie, said her client has been stressed about his future since leaving his mother’s worldwide tour previous year to stay with Ritchie in London, where he now attends school.
Per exchanges at the hearing, the exes had apparently neared an agreement outside of court but seemed to have come to blows in the eleventh hour.
The children had accompanied her on her Rebel Heart tour, which began in Montreal in September and has seen her criss-cross the US, Europe, South America and Asia.
Kaplan went on to admit their failure to reach an agreement was “extremely troubling”, before insisting their petty attacks were damaging to young Rocco, who has since been enrolled in a school in London. During the hearing, Rocco’s attorney reportedly said the entire situation is having a negative effect on their son, but the judge says the real problem is the “inability of the parents to come up with a solution”.
Rocco’s been living in England with his dad since December.
The judge refused to order Ritchie to return Rocco to NY, so as not to “disrupt the household” or Rocco’s schooling.
“Rocco is of an age where he can not be physically compelled on a plane to come back to NY because he doesn’t want to”, Bronstein said.
“Amber Portwood taught his son that obeying court orders … is not necessarily important”. The couple divorced in 2008 and agreed Rocco would live with Madonna.
In the intervening period, Madonna has been sharing a string of posts on social media expressing how much she misses her son. Sharing a photo of Rocco at a happier time with a floral garland around his neck she wrote, “I miss this boy so full of life so full of love! The light is blinding!”
The pair’s hearing is tentatively scheduled for June 1.
The judge urged Madonna and her ex-husband, British film director Guy Ritchie, to quickly resolve the dispute over who the boy will live with, and to think of his best interests.
The “Rebel Heart” singer, 57, now on the Australasian leg of her world tour, had Rocco join her for the initial stages of the tour, working backstage.
In December, the teen ignored a court order to fly back to NY to reside with his mother.
When it comes to the custody disagreements, a source close to the couple shared with the outlet, “She always has to be right”.
He is now living with Guy, 47, his wife Jacqui Ainsley and their three children, Rafael, four, Rivka, three, and Levi, 18 months, in the United Kingdom and has so far defied calls for him to return to the US.
