San Francisco sues President Donald Trump

Organizers described the event as a community-based demonstration and performance art piece meant to be a “shining beacon of inclusiveness and democracy”.

San Francisco is suing the Trump administration over an executive order requiring the federal government to withhold money from so-called sanctuary cities that protect undocumented immigrants from federal prosecution.

Sanctuary cities adopt policies that limit cooperation, such as refusing to comply with US.

The U.S. government can not “put a gun to the head of states and localities” to carry out federal dictates, City Attorney Dennis Herrera said at a news conference with Mayor Ed Lee.

On Tuesday – a day after San Francisco announced a lawsuit against the Trump administration – elected officials in Santa Rosa, Oakland and Santa Clara County cast votes showing their commitment to protecting undocumented residents and pushing back against Trump’s anti-immigrant policies.

“Local government should not be mandated to enforce federal immigration laws, particularly when resources necessary to enforce local laws are already stretched”, the city policy reads.

Johnson observed that local police officers usually prioritize making sure immigrant communities aren’t too intimidated to cooperate with investigations, which is why cities like San Francisco typically ignore detainers.

Pratheepan Gulasekaram, an immigration and constitutional law professor at Santa Clara University, said the city appears to be solid ground.

The suit was filed on Tuesday by San Francisco city attorney Dennis Herrera.

According to Herrera, the executive order defies the 10 Amendment of the American Constitution, which mentions that the powers which are attributed to the Federal Government are the state’s concern.

San Francisco is one of a few sanctuary cities in the Bay Area, including San Jose, Oakland and Berkeley. Numerous safest cities in the nation are also located on or near the Mexican border – including El Paso, San Diego, San Antonio, Austin and Tucson, a fact acknowledged by even some leading conservative voices. San Francisco gets $1.2 billion in those funds and Oakland gets $130 million, for example.

There are approximately 400 cities and counties throughout the United States that have some form of sanctuary policy on the books, according to Wong’s study.

For now, advocates are urging immigrants and their allies to show up to public actions, and to call their two U.S. Senators and their member of Congress to voice their opposition to Trump’s executive orders on immigration. Trump then brazenly set out plans to take on so-called “sanctuary cities” that now refuse to use their resources and personnel to assist in deporting people for minor crimes (or arrests that don’t result in a charge).

San Francisco is one of the 400 sanctuary cities in the United States that have sanctuary laws to combat federal immigration policies that some find extreme, especially in relation to minor and non-violent crimes.

Trump signed the directive on sanctuary cities on January 25, along with an executive order to build a wall along the U.S.
