After Scalia died unexpectedly, former Democratic President Barack Obama nominated a replacement, but Republicans for months refused to consider him, blocking a leftward shift on the court.
“Judge Gorsuch has repeatedly sided with corporations over working people, demonstrated a hostility toward women’s rights, and most troubling, hewed to an ideological approach to jurisprudence that makes me skeptical that he can be a strong, independent Justice on the Court”, Schumer said in a statement. If confirmed by the Senate, Gorsuch would restore a narrow 5-4 conservative majority on the court. Democrats have dug up so little on the supremely qualified Supreme Court nominee that they’ll be huffing and puffing and pretending to body slam the judge around the hearing room.
Their attitude on holding the court at a mere eight judges changed dramatically once President Donald Trump was sworn into office. And yesterday, Sen. Richard Blumenthal (D-Conn.) tweeted he will “relentlessly” oppose Gorsuch’s nomination if he doesn’t reject Trump’s “litmus test”, requiring nominees be anti-choice and pro-gun rights.
Due to Republican control of the Senate, Gorsuch is expected to eventually be confirmed to the court.
Yet Senate Democrats should recall that Gorsuch has come before them in the past. Even some Democrats still furious over the GOP power play are quietly forecasting Gorsuch’s eventual success.
Written with his customary accessible clarity, Gorsuch’s opinion in the Caplinger case was one of hundreds he has authored since he joined the bench as a President George W. Bush appointee in 2006.
The Democrats already have telegraphed another aspect of their strategy: If the nomineedodges, or refuses to answer their questions, that will be more fodder for their opposition.

Carrie Severino, who is leading JCN’s work on the Gorsuch fight, said she was somewhat surprised by Democrats’ lack of spending – and that it was easier to make their argument on less-cluttered airwaves. “We need you to do better”.
Republicans have praised Gorsuch’s 11-year record on the Denver-based 10th U.S. Circuit Court of Appeals.

Dianne Feinstein, D-Calif. “His decisions interpreting federal disability rights statutes, including the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act and the Individuals with Disabilities Education Act (IDEA) reflect this enmity as well as his misapprehension of these laws and their policy goals”. We have different political beliefs. Because Republicans holding the Senate majority at 52, it’s hard to say if Democrats will be able to muster the 60-vote super majority needed to block Gorsuch’s confirmation without attempting a filibuster. But Republicans have their own plan to deal with a potential filibuster: Going nuclear. Instead of bringing him up for a vote, however, Senate Majority Leader Mitch McConnell chose to keep the court seat vacant until after the November 2016 election, which Mr. Trump won.
“Considering the length of these things, which is not very long, and considering his really vast experience in public speaking and advocacy, it’s cool, and he’s very, very impressive, but I don’t think it’s as spectacular as you might otherwise think”, she said. “I would say it’s up to Mitch, but I would say, ‘Go for it'”.
