In addition to his NLRB appointment, Acosta was named by former President George W. Bush as an assistant attorney general for civil rights. He became dean of Florida International University College of Law in 2009.
“Andy Puzder made the right and honorable choice by withdrawing from consideration as labor secretary”, Republican Senator Marco Rubio said in a tweet.
Puzder, who previously lead the company that owns fast food chains Carl’s Jr. and Hardee’s, came under fire earlier this month after reports that he and his wife had employed an undocumented immigrant for housework.
Before his withdrawal, GOP leaders were urging the White house to pull the nomination when four Republicans said they would cast no votes and as many as 12 were ready to bolt, according to CNN.
President Trump announced Thursday morning that he will hold a press conference at the White House at noon. Puzder was slated to have his confirmation hearing on Thursday.
Rubio said he had known Acosta professionally and socially and that he would be visiting with Senate Democrats to convince them that there should be no fight over Acosta’s nomination.
Puzder is the first of Trump’s cabinet nominees to withdraw his nomination.
Puzder had been losing support within Senate Republicans, with up to 12 Republican senators thought to be wavering on voting him in.

The Oprah Winfrey Network released the video and the Senate HELP committee and Chairman Lamar Alexander, R-Tennessee, provided several viewings of the show for committee members.
