Couch pleaded guilty to four counts of intoxication manslaughter and two counts of intoxication assault causing serious bodily injury.

At the time, many were outraged that a judge sentenced him to probation instead of jail time, slamming his now-notorious “affluenza” defense.

Prosecutors want to see Couch in an adult court, but because the alleged violation happened in the juvenile system, Couch effectively would start with a clean slate in the adult probation system.

If the judge declines to transfer Couch to adult court, Wilson will ask that his probation be revoked, in which case he could be held in a juvenile facility until his sentence expires when he turns 19 next April.

Couch was declared officially missing December 10 when he did not appear at a mandatory meeting with his probation officer. He is expected to stay there while his deportation appeal is considered. The judge has three days to consider the appeal.

Ethan Couch probably will be able to stay in Mexico for longer than the next three days because of the holidays, Richard Hunter, chief deputy U.S. Marshal for the southern district of Texas, said in a Wednesday news conference. She was in the custody of marshals.

On Thursday, the Los Angeles Police Department confirmed to ABC News that she is in segregation, which means that she is effectively in solitary confinement. Bail was set at $1 million.

If found to have violated his probation, it could be revoked and Couch could face up to four months in jail.

Authorities say Couch fled to Mexico with her 18-year-old son as Texas prosecutors investigated whether he violated probation in a drunken-driving case.

Eisenman says Couch will be held until US marshals arrive to take her to Texas, where she and her son, 18-year-old Ethan Couch, live and where he was on probation for the 2013 crash.
